<p><strong>ملخص البحث</strong></p>
<p>تعد المعلومات التي تم المحافظة عليها وأحيطت بالسرية ذات قيمة تجارية وتنافسية بأن يعطيها القانون حماية كافية يمكن من خلالها أن يطلب مالك المعلومات غير المفصح عنها من المحكمة الدعم في حالة تم</p>
<p>الاعتداء عليها، أو في حالة محاولة تسريبها أو إفشائها.</p>
<p>كما أن هناك أساسا للحماية القانونية، فهي إما حماية عقدية عند وجود عقد مبرم بين الطرفين، ويجب أن يتوفر الخطأ العقدي والضرر والعلاقة السببية، أو غير عقدية؛ أي ضد الغير، ويمكن الرجوع عليها حسب النظريات التي تحمي المعلومات غير المفصح عنها؛ مثل نظرية الإثراء بلا سبب، وكذلك نظرية الملكية؛ بوصفها أداة لحماية المعلومات غير المفصح عنها، ونظرية المنافسة بطرق غير مشروعة، والمسؤولية غير التعاقدية.</p>
<p>كما أن الحماية القضائية للمعلومات غير المفصح عنها تكون عن إيقاع المسؤولية المدنية والإجرائية على كل معتد، وتكون من خلال الإجراءات التحفظية ورفع دعوى مستعجلة، أو من خلال دعوى مدنية للمطالبة بالتعويض عن الضرر، والتعويض إما نقدي أو عيني، أو بدعوى جزائية لمعاقبة كل من يتعدى على المعلومات غير المفصح عنها.</p>

<p style="text-align: left;">The Legal protection of undisclosed information: A comparative analysis in light of the TRIPS Agreement and UAE legislation Information that has been kept confidential and posses commercial and competitive value is deemed to be given adequate protection by law through which the owner of the undisclosed information can request support from the court in the event of an attack or an attempt to leak or disclose it.</p>
<p style="text-align: left;">The legal protection is based either on contractual protection when there is a contract between the two parties, and in this case the contractual error, ccurrence of damage, and causal relationship must be present for a lawsuit case. Or noncontractual protection, that is, against third parties, which can be referred to according to theories that protect undisclosed information, such as the enrichment without reason theory, the theory of property; as a tool to protect undisclosed information, as well as the theory of unfair competition and non-contractual liability.</p>
<p style="text-align: left;">Judicial protection for undisclosed information involves imposing civil and procedural liability on every aggressor, and it takes place through precautionary</p>
<p style="text-align: left;">measures and filing an urgent lawsuit, or through a civil lawsuit to demand compensation for damage, that shall be either in cash or in-kind, or through a criminal lawsuit to punish anyone who violates the undisclosed information protection legislation.</p>
