Abstract
<p>المستخلص:</p>
<p>تناولت الدراسة موضوع الحماية الجنائية للمستهلك الإلكتروني من الإعلان التجاري المضلل " دراسة مقارنة "، وكان الاهتمام منصبا علي بيان مفهوم المستهلك ومبررات حمايته ، وقد تناولت الدراسة بيان اختلاف فقهاء القانون في تحديد معيار سمة التضليل بالإعلان المضلل، وصب الباحث جل اهتمامه على صور الإعلان التجاري المضلل، والتي تتجلى في صورتين: الصورة الأولى: الإعلان عن سلعة أو خدمة بناء على معلومات خادعة أو إغفال معلومات جوهرية أو أساسية ذات ارتباط في السلعة أو الخدمة، والصورة الثانية من صور الخداع هي الإعلان عن جوائز أو تخفيضات وهمية أو غير حقيقية.</p>
<p>كما تناولت الدراسة بيان الأركان القانونية لجريمة الإعلان المضلل متضمناً طبيعة الركن المادي والمعنوي، وتم تسليط الضوء على المسؤولية الجزائية الناجمة عن جريمة الخداع في الإعلان المضلل سواء للشخص الطبيعي أو الاعتباري.</p>
<p>وتناول الباحث الحماية الإجرائية للمستهلك الإلكتروني من جريمة الإعلان المضلل، متضمناً إجراءات الملاحقة والتحقيق والمحاكمة، وصب الباحث جل اهتمامه على اجراء ضبط الأدلة الإلكترونية والقانون الواجب النفاذ والصعوبات التي تواجه سلطة الاستدلال والتحقيق في الجرائم الإلكترونية، وتم تسليط الضوء على حجية الأدلة الإلكترونية في الإثبات.</p>
<p>كما تناولت الدراسة حالات انقضاء الدعوى الجزائية والأثار المترتبة عليه، وحق المضرور من الجريمة، وتناولت الدراسة صلاحيات النائب العام بعد انقضاء الدعوى الجزائية للتصالح.</p>
<p>وأكسبت هذه الدراسة أهمية بسبب خطورة جريمة الإعلان المضلل على المستهلك، وهدف الباحث من وراء الدراسة الى محاولة إظهار الحماية الجنائية للمستهلك من جريمة الإعلان المضلل في التشريعات المقارنة، وموقف التشريع الإماراتي منه، ومعرفة مدى كفاية النصوص المتعلقة بالإعلان المضلل.</p>

<p>Abstract:</p>
<p>The study addressed the issue of criminal protection of the electronicconsumer from misleading commercial advertising. Attention wasfocused on explaining the concept of the consumer and the justificationsfor his protection. The study dealt with explaining the differences oflegal scholars in determining the criterion for the deceptioncharacteristic of misleading advertising, and the researcher focusedmost of his attention on the images of misleading commercialadvertising, which appear in two images, the first image. Advertisinga good or service based on deceptive information or omitting essential orbasicinformation related to the good or service. The second form ofdeception is advertising fictitious or unreal prizes or discounts.</p>
<p>The study also addressed the legal elements of the crime of misleading advertising, including the nature of the material and moral elements, and highlighted the criminal liability resulting from the crime of deception in misleading advertising, whether for a natural or legal person.</p>
<p>The researcher discussed the procedural protection of the electronic consumer from the crime of misleading advertising, including procedures for prosecution, investigation, and trial. The researcher focused most of his attention on the procedure for controlling electronic evidence, the enforceable law, and the difficulties facing the authority of inference and investigation of electronic crimes. The authority of. electronic evidence in proof was highlighted</p>
<p>The study also dealt with the cases of the expiration of the criminal case and its consequences, and the rights of the person harmed by the crime. The study also dealt with the powers of the Public Prosecutor after the expiration of the criminal case for reconciliation.</p>
<p>This study gained significance due to the severity of the crime of misleading advertising on consumers. The researcher's aim behind the study is to attempt to highlight the criminal protection for consumers against misleading advertising in comparative legislations. Additionally, it seeks to understand the stance of the UAE legislation on this matter and assess the adequacy of the texts related to misleading advertising.</p>
<p>The researcher relied on the analytical and comparative approach between the legal organization of the UAE and the Arab Republic of Egypt.</p>
<p>The researcher reached several results, the most important of which are:</p>

<li>The crime of misleading advertising is characterized by the element of deception. However, legal scholars differ in assessing the applicable standard. Some adopt the personal standard, while others adhere to the objective standard.</li>
<li>The law on rumors and electronic crimes does not include specific legal procedures related to the regulation of digital evidence , its admissibility criteria , and leaving it to the discretion of the judge to determine its acceptance.</li>
</ol>
<p>The researcher reached several recommendations, the most important of which are:</p>

<li>The researcher recommended that the UAE legislator determine the criminal liability of Internet intermediaries according to special texts.</li>
<li>The researcher proposed to the Emirati legislator to enshrine special procedural rules in the law on combating rumors and electronic crimes related to detecting the crime and its perpetrator, similar to the Bahraini legislator.</li>
