<p style="direction: rtl;">إن عقد العمل الدولي من العقود التي تمتاز بخصوصية، كونها تختلف عن باقي العقود خاصة من ناحية تحديد الصفة الدولية على العقد المائل ، ذلك لأن مسألة تحديد القانون الواجب التطبيق من المسائل الصعبة ، والتي قد أثارت جدلا على مستوى الفقه والقضاء ، بغرض الوصول إلى تبيان المعيار المعتمد في تحديد دولية العقد الماثل وما زاد الأمر تعقيدا في عقد العمل هو اعتبار هذا الأخير من عقود الإذعان ، ما أدى إلى وجود تناقض بين القضاء والفقه حول تحديد القانون الواجب التطبيق على هذا العقد ، وبقيت الحلول متضاربة حول تطبيق قانون الإرادة أو تركيز علاقة العمل ، لينتهي الأمر وبترك المجال مفتوحا أمام الاجتهاد القضائي بشكل مباشر. الكلمات المفتاحية تنازع القوانين، عقد العمل، قانون الإرادة، نظرية التركيز الاجتهاد القضائي، عقد العمل الدولي، معايير تحديد دولية العقد، علاقة عمل الفردية.</p>

<p style="direction: rtl; text-align: left;">The international employment contract is one of the contracts that is characterized by its specificity, as it differs from other contracts, especially in terms of determining the international nature of the contract, because the issue of determining the applicable law is a difficult issue, which has raised controversy at the level of jurisprudence and the judiciary, in order to reach a clarification of the standard adopted in determining the internationality of the present contract. What made the matter more complicated in the employment contract is that the latter is considered a contract of adhesion, which led to a contradiction between the judiciary and jurisprudence regarding determining the applicable law to this contract, and the solutions remained conflicting regarding the application of the law of will. Or focusing the employment relationship, to end up leaving the field open to direct judicial interpretation.
