Abstract

<p style="direction: rtl; text-align: right;">تناول البحث موضوع النظام القانوني للتوطين في القطاع الخاص في دولة الإمارات العربية المتحدة، وتهدف الرسالة إلى بيان ماهية التوطين في القطاع الخاص ومبرراته، وتحديد النظام القانوني لبرامج التوطين في القطاع الخاص في دولة الإمارات العربية المتحدة، وبيان مساهمة التوطين في القطاع الخاص في الاستفادة من الكفاءات الإماراتية في كافة الميادين، وتحديد معوقات وصعوبات التوطين في القطاع الخاص في دولة الإمارات العربية المتحدة، بالإضافة لبيان مدى فعالية برامج وتشريعات التوطين في القطاع الخاص. تتمثل أهمية الدراسة من الناحية العلمية في انها من أوائل الدراسات في دولة الإمارات العربية المتحدة التي تتناول موضوع في غاية الأهمية ، وهو التوطين في القطاع الخاص ، حيث ان الدراسة تكتسب أهميتها العلمية من أهمية موضوعها المحوري الذي يهم شريحة واسعة من الإماراتيين ، كما انها من الدراسات الهامة لمنشآت القطاع الخاص في دولة الإمارات العربية المتحدة كونها تسلط الضوء على إجراءات التوطين ومستهدفاته والمنشآت المعنية ، كما انها تبين نسبة مساهمة الحكومة في دولة الإمارات العربية المتحدة في التوطين من خلال بيان نسبة المساهمة المالية ، كما ان الدراسة تبين أثر التحايل على عملية التوطين ولا سيما من حيث التوطين الصوري وتبين العقوبات الواردة على مثل هذا الفعل ، كما ان الدراسة تسهم من خلال ما ستصل لــه مــن نتائج وتوصيات في إثراء البحث العلمي القانوني في مجال التوطين بحيث تعتبر قاعدة للدراسات المستقبلية في هذا المجال. وتعتمد الدراسة على المنهج الوصفي والتحليلي تعتمد الدراسة على المنهجين الوصفي التحليل اما المنهج الوصفي يكون من خلال تقديم وصف لموضوع الدراسة من الناحية النظرية من خلال بيان مفاهيم الدراسة ومبررات التوطين في القطاع الخاص في دولة الإمارات العربية المتحدة ، في حين أن المنهج التحليلي يكون من خلال تحليل الآراء الفقهية القانونية واحكام النصوص التشريعية التي تنظم التوطين في القطاع الخاص والقرارات الوزارية الخاصة بالتوطين في القطاع الخاص ، اما المنهج التحليلي يكون من خلال إجراء مقارنة بين موقف دولة الإمارات العربية المتحدة من تنظيم التوطين في القطاع الخاص عبر برنامج نافس.</p>
