Abstract
<p style="direction: rtl;"><strong>المستخلص</strong></p>
<p style="direction: rtl;">هدف البحث إلى التعرف على الشروط الشكلية والموضوعية لتقرير الخبير في المسائل الجزائية، وتوضيح ضمانات المتهم في مراحل الدعوى الجزائية بشأن الاستعانة بالخبرة، وبيان مدى حجية تقرير الخبير في الإثبات الجنائي وأسباب بطلانه، والوقوف على أن سلطة القاضي الجنائي في تقدير تقرير الخبرة القضائية. وتمثلت مشكلة البحث في المشرع الإماراتي لم يضع نصوصا تفصيلية لإجراءات الخبرة في المسائل الجزائية، لاسيما وأن الخبرة مهمة فنية ومحددة يتم الاستعانة بها في الإثبات الجنائي في كافة مراحل الدعوى الجزائية لتقدير المسائل الفنية والتقنية التي يحتاج تقديرها إلى معرفة خاصة.</p>
<p style="direction: rtl;">واعتمد البحث على المنهج الوصفي والمنهج التحليلي المقارن من خلال تحليل النصوص القانونية التي تعالج موضوع الدراسة في كل من المرسوم بقانون اتحادي رقم (21) لسنة 2022 بشأن تنظيم مهنة الخبرة أمام الجهات القضائية والمرسوم بقانون اتحادي رقم (38) لسنة 2022 بشأن الإجراءات الجزائية، مقارنة بالتشريع المصري.</p>
<p style="direction: rtl;">وتوصل البحث إلى عدة نتائج أهمها أن الخبرة القضائية في مرحلة المحاكمة تستهدف مساعدة القاضي في تكوين عقيدته للفصل في الدعوى الجزائية، وهو في سبيل ذلك إما أن يستدعي الخبير الذي سبق له أداء مأموريته أمام سلطة التحقيق الابتدائي لتقديم إيضاحات عن التقرير المقدم منه، وإما أن يطلب من الخبير أداء مهام جديدة، سواء كان الأمر يتعلق بمسألة سبق له فحصها أو لم تكن كذلك. وأوصى الباحث بأن ينص المشرع الإماراتي على نظام الخبرة الاستشارية في المسائل الجزائية، وذلك من خلال إضافة فقرة إلى المادة (94) من المرسوم بقانون اتحادي رقم (38) لسنة 2022 بشأن الإجراءات الجزائية، وذلك على النحو الآتي: " للمتهم والمجني عليه والمدعي بالحق المدني الاستعانة بخبير استشاري أو أكثر في ما له صلة بالجريمة التي يجري التحقيق فيها ".</p>
<p><strong>Abstract</strong></p>
<p>The research aimed to identify the formal and substantive conditions of the expert report in criminal matters, clarify the guarantees of the accused in the stages of the criminal case regarding the use of expertise, clarify the extent of the validity of the expert report in criminal evidence and the reasons for its invalidity, and identify the authority of the criminal judge in assessing the judicial expertise report. The problem of the research was that the UAE legislator did not set detailed texts for the procedures of expertise in criminal matters, especially since expertise is a technical and specific task that is used in criminal evidence in all stages of the criminal case to assess technical and technical issues that require special knowledge to assess.</p>
<p>The research relied on the descriptive approach and the comparative analytical approach by analyzing the legal texts that address the subject of the study in both Federal Decree - Law No. (21) of 2022 regarding the regulation of the profession of expertise before the judicial authorities, and Federal Decree - Law No. (38) of 2022 regarding criminal procedures, compared to Egyptian legislation.</p>
<p>The research reached several results, the most important of which is that judicial expertise in the trial stage aims to help the judge form his belief to adjudicate the criminal case. To do so, he either summons the expert who has previously performed his mission before the preliminary investigation authority to provide clarifications on the report submitted by him, or asks the expert to perform new tasks, whether it is related to a matter that he has previously examined or not. The researcher recommended that the UAE legislator stipulate the system of consulting expertise in criminal matters, by adding a paragraph to Article ( 94 ) of Federal Decree - Law No. ( 38 ) of 2022 regarding criminal procedures, as follows: " The accused, the victim, and the civil claimant may seek the assistance of one or more consulting experts in what is related to the crime being investigated ".</p>
