<p style="text-align: right;"><strong>المستخلص </strong></p>
<p style="text-align: right;">تدور الدراسة حول موضوع النظام الإجرائي لحبس المدين في القانون الإماراتي، حيث أن المشرع الإماراتي حرص على كفالة التوازن بـيـن الحـق فـــي الحرية وبين حقوق الآخرين، فقد نظم قواعد أوردها في قانون الإجراءات المدنية الفصل الأول من الباب الخامس تحت عنوان حبس المدين.</p>
<p style="text-align: right;"> تمثلت إشكالية الدراسة في تقييم موقف المشرع الإماراتي من التنفيذ على شخص المدين بحبسه، كطريقة من طرق التنفيذ الجبري، كما أن هناك إشكالية رئيسية في قانون الإجراءات المدنية الإماراتي رقم (42) لسنة 2022، وذلك في المادة (3/319) منها، فلم يذكر المشرع ما هو الإجراء المتبع في حال مازال المدين متعنتاً عن الوفاء عند انتهاء القانون وهي ستة وثلاثين شهراً.</p>
<p style="text-align: right;">سعت الدراسة لبيان مفهوم حبس المدين وكيفية إجراءات حبس والمقارنة في بعض المواضع بالقانون الأردني والقانون المصري للتوصل إلـــى أوجه الشبه والاختلاف بين القانون الإماراتي والقوانين المذكورة، مــن خـلال فصلين، الأول خصص لبيان ماهية حبس المدين وحالاته، والثاني تناول إجراءات حبس المدين وموانع الحبس.</p>
<p style="text-align: right;">في نهاية الدراسة توصلنا لنتائج وتوصيات، فكان من أهم النتائج أن حبس المدين يؤدي إلى استقرار المعاملات، لأنه سيؤدي حتماً إلى عدم تقاعس المدين عن الوفاء وإسراعه إلى سداد الدين خشية الحبس. أما أهم توصيات الدراسة فهي: إضافة وبيان مدة الحبس بشكل واضح إذا لم يكن للمدين إقامة مستقرة في الدولة أو كان يخشى هروبه</p>

<p style="text-align: left;"><strong>Abstract</strong></p>
<p style="text-align: left;">The study revolves around the subject of the procedural system for imprisonment of the debtor in Emirati law, as the Emirati legislator was keen to ensure a balance between the right to freedom and the rights of others. He organized rules that he included in the Code of Civil Procedure in the first chapter of Part Five under the title of imprisonment of the debtor.</p>
<p style="text-align: left;">The problem of the research was to evaluate the position of the Emirati legislator regarding the execution of the debtor's person by imprisoning him, as a method of forced execution. There is also a major problem in the UAE Civil Procedure Law No. (42) of 2022, in Article (319/3) thereof, so it was not mentioned. The legislator: What is the procedure to be followed in the event that the debtor is still stubborn in payment upon the end of the total periods of imprisonment of the debtor specified in the law, which are thirty-six months.</p>
<p style="text-align: left;">The study sought to explain the concept of debtor imprisonment and the procedures for debtor imprisonment, and to compare in some places with Jordanian law and Egyptian law to find similarities and differences between Emirati law and the aforementioned laws, through two chapters, the first devoted to explaining the nature of debtor imprisonment and its cases, and the second dealing with debtor imprisonment procedures and imprisonment contraindications.</p>
